OVERVIEW
Welcome to Lushielle.
Lushielle is a trading name operated by AG Ecom, established in the Netherlands. Throughout these Terms, the terms “Lushielle”, “we”, “us” and “our” refer to AG Ecom trading as Lushielle.
We operate the website lushielle.com and provide access to our online store, products, information, content and related services (collectively, the “Services”).
Our store is powered by Shopify.
These Terms of Service, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and other policies published on our website, govern your use of our Services and purchases made through our online store.
By using our Services or placing an order, you agree to these Terms.
Nothing in these Terms excludes, restricts or limits any mandatory consumer rights that apply to you under the laws of your country.
SECTION 1 – ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding agreement under the laws applicable to you in order to place an order with us.
When placing an order or creating an account, you agree to provide accurate, complete and current information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activities carried out through your account.
You may not use our Services for unlawful or fraudulent purposes.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, specifications, colours, measurements and other information displayed on our website are accurate.
However, colours and appearance may vary depending on your device, display settings, lighting and other circumstances.
Minor differences that do not materially affect the nature, quality or functionality of a product may occur.
Nothing in this section affects your statutory rights where a product is faulty, damaged, materially different from its description or otherwise does not conform to the contract.
We may modify or discontinue products and may limit quantities where reasonably necessary.
SECTION 3 – ORDERS AND CONTRACT FORMATION
By submitting an order, you offer to purchase the selected products at the displayed price.
After placing your order, you will normally receive an electronic confirmation.
We reserve the right to refuse or cancel an order before fulfilment where there is a legitimate reason to do so, including:
suspected fraud or misuse, incorrect pricing caused by an obvious error, product unavailability, payment failure, restrictions on shipping the product to your destination, or a clear technical error affecting the order.
If we cancel an order after payment has been collected, we will refund the relevant amount to the original payment method.
Please check your order details carefully before submitting your order.
If you wish to change or cancel an order, contact support@lushielle.com as soon as possible. We cannot guarantee cancellation once processing or fulfilment has begun.
Your cancellation and return rights after delivery are described in our Return & Refund Policy.
SECTION 4 – PRICES, CURRENCIES AND PAYMENT
Prices are displayed in the currency applicable to your selected market or location.
Product prices and promotions may change from time to time. Changes do not affect orders that have already been accepted.
Any applicable shipping charges, taxes and other charges that we are required to disclose will be shown or communicated before you complete your purchase.
Where duties, import taxes or similar charges apply, their treatment is described in our Shipping Policy and/or during checkout.
You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method selected.
Payments may be processed by Shopify Payments or other third-party payment providers made available during checkout.
SECTION 5 – SHIPPING AND DELIVERY
Our processing times, estimated delivery times, shipping charges, delivery regions and other shipping information are described in our Shipping Policy.
Delivery dates and timeframes are estimates unless expressly stated otherwise or applicable law provides otherwise.
We remain responsible for the shipment where required by applicable consumer law.
Where we arrange the carrier, risk of loss or damage will not pass to you merely because the parcel has been handed to the carrier.
Nothing in these Terms limits your rights relating to late, lost, damaged or undelivered orders.
SECTION 6 – RETURNS, CANCELLATIONS AND REFUNDS
Returns, statutory withdrawal rights, refunds, defective products and order cancellations are governed by our Return & Refund Policy.
Lushielle provides a 14-day change-of-mind return period subject to the conditions described in that policy.
Customers in jurisdictions that provide additional mandatory cancellation, warranty or consumer-guarantee rights retain those rights in full.
In particular, these Terms do not limit statutory protections applicable to consumers in the European Union, United Kingdom, Australia, New Zealand, Canada, the United States or other jurisdictions in which we sell.
SECTION 7 – INTELLECTUAL PROPERTY
Unless otherwise stated, the content of the Services, including our branding, logos, text, graphics, designs, photographs, videos and website layout, is owned by or licensed to Lushielle and is protected by applicable intellectual property laws.
You may use the Services for personal and non-commercial purposes.
You may not copy, reproduce, distribute, commercially exploit or create derivative works from our protected content without prior permission, except where permitted by law.
Third-party trademarks and intellectual property remain the property of their respective owners.
SECTION 8 – THIRD-PARTY SERVICES AND LINKS
Our Services may contain third-party applications, payment services, tools, integrations or links to external websites.
We are not responsible for independent third-party websites or services that are outside our control.
Your use of a third-party service may also be subject to that provider’s own terms and privacy policy.
Nothing in this section excludes responsibility that cannot legally be excluded.
SECTION 9 – SHOPIFY
Lushielle is powered by Shopify, which provides the ecommerce infrastructure that enables us to offer our Services.
However, purchases made through our store are made directly between you and Lushielle / AG Ecom.
Shopify is not the seller of the products offered through our store.
Your use of certain Shopify functionality may also involve processing of personal information by Shopify, as explained in our Privacy Policy.
SECTION 10 – PRIVACY
Our collection and use of personal information is governed by our Privacy Policy.
Because our store is hosted by Shopify, Shopify also processes certain personal information necessary to provide the ecommerce platform and related services.
Please review our Privacy Policy for more information about the types of data collected, purposes of processing, international transfers, cookies and your privacy rights.
SECTION 11 – REVIEWS AND USER CONTENT
If you voluntarily submit a review, photograph, comment or other content to Lushielle, you confirm that you have the right to submit that content.
You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use that content for operating and promoting Lushielle, subject to applicable privacy and consumer laws.
You must not submit content that is unlawful, fraudulent, misleading, abusive, defamatory or infringes another person’s rights.
We may moderate or remove unlawful or inappropriate content where reasonably necessary.
We will not misrepresent consumer reviews or create false impressions about the origin or authenticity of reviews.
SECTION 12 – ERRORS AND INACCURACIES
Occasionally our website may contain typographical errors, technical errors or inaccurate information relating to products, pricing, availability or promotions.
We may correct genuine errors and update information where reasonably necessary.
If an error materially affects an order you have already placed, we will contact you and, where appropriate, provide the option to proceed under the corrected terms or receive a refund.
Nothing in this section allows us to avoid obligations arising under applicable consumer law.
SECTION 13 – PROHIBITED USES
You may not use the Services to:
violate applicable law; commit or facilitate fraud; infringe intellectual property rights; transmit malicious software; interfere with the security or operation of our website; harvest personal information unlawfully; send spam or unsolicited communications; impersonate another person; or otherwise misuse the Services in a way that causes unlawful harm to Lushielle, our customers or third parties.
We may restrict access to the Services where reasonably necessary to protect our business, customers, systems or legal obligations.
SECTION 14 – SERVICE AVAILABILITY
We aim to keep our website and Services available and functioning correctly.
However, temporary interruptions may occur as a result of maintenance, technical problems, updates or circumstances outside our reasonable control.
We do not guarantee uninterrupted availability of the website.
This does not affect any rights relating to orders already placed.
SECTION 15 – CONSUMER GUARANTEES AND WARRANTIES
Products purchased from Lushielle are subject to all mandatory guarantees, warranties and consumer rights applicable under relevant law.
Nothing in these Terms excludes or limits:
statutory guarantees relating to quality, conformity, safety or description;
rights relating to faulty, defective or misdescribed goods;
mandatory remedies such as repair, replacement, price reduction, cancellation or refund; or
any other right that cannot lawfully be excluded.
For EU consumers, statutory conformity rights apply independently of our voluntary return policy. EU consumer rules require remedies where goods are faulty or do not conform to what was agreed.
Consumers in Australia retain all applicable rights under the Australian Consumer Law.
Consumers in New Zealand retain all applicable rights under the Consumer Guarantees Act and Fair Trading Act.
SECTION 16 – LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot legally be excluded, or mandatory consumer rights and remedies.
To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from your unlawful or improper use of the Services.
If you use our Services as a consumer, we do not exclude liability for losses that applicable consumer law makes us responsible for.
SECTION 17 – EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for a failure or delay caused solely by events outside our reasonable control, such as severe weather, natural disasters, major transport disruptions, governmental actions, strikes, war, widespread telecommunications failures or similar events.
Where such an event affects an existing customer order, we will continue to comply with any mandatory cancellation, refund or delivery rights applicable to that customer.
SECTION 18 – TERMINATION OF WEBSITE ACCESS
We may suspend or terminate access to our Services where a user materially breaches these Terms, engages in fraud or unlawful conduct, threatens the security of the Services or otherwise misuses the website.
Termination of website access does not remove rights or obligations relating to orders already concluded unless applicable law permits otherwise.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue to apply.
SECTION 20 – NO WAIVER
If we do not immediately exercise a right available to us under these Terms, this does not mean that we waive that right.
SECTION 21 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our Services, business practices or applicable law.
The version applicable to an order is generally the version in effect when that order was placed, unless applicable law provides otherwise.
Material changes will be communicated where required by law.
SECTION 22 – GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts concluded with Lushielle are governed by the laws of the Netherlands, subject to mandatory consumer protection rules.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory protections that apply to you under the laws of your country of habitual residence.
Nothing in these Terms limits your right to bring proceedings before a court or other competent body where such a right is granted by mandatory applicable law.
SECTION 23 – ENTIRE AGREEMENT
These Terms, together with the policies and information expressly incorporated into them, form the agreement governing your use of our Services and purchases from us.
If there is a conflict between these Terms and a mandatory provision of consumer law, the mandatory consumer-law provision will prevail.
